The Intangible Asset (IA) service line assists clients to convert ideas into intellectual property and then, in light of this intellectual property, to assess how strong their commercialisation position is.

What are Intangible Assets?

Intangible Assets are non-monetary and non-physical assets created through time and effort.

Intangible Assets include ideas, designs, fonts, names, tag lines, colours, data, systems, procedures, customer and supplier relationships, know how, collaboration activities, leverage activities and structural activities, etc.

How to Create Intellectual Property

By converting intangible assets into intellectual property, legal property rights are created. Trademarks, copyright, domain names, design registration and patents are some of the classes of intellectual property that offer different forms of legal protection.

Commercialisation Position Review

A commercialisation position review determines the strength and scope of a client's intellectual property. By way of analogy: a company's commercialisation position is similar to the foundation of a house: if the foundation is weak or small this limits the size and type of house that can be built. A weak Commercialisation Position will significantly restrict the commercial potential of the owner's ideas. Conversely if the foundation is deep and broad, the size of the house (the commercial potential) that can be built is much larger and the type and style of the house that can be built (the commercialisation options), will be more varied and flexible.

Before committing to an expensive intellectual property protection strategy, such as patenting, it is critical to determine whether a strong or weak intellectual property portfolio is likely to be generated. Building and maintaining an intellectual property portfolio is expensive and costs essentially the same regardless of whether the intellectual property protection ultimately produced is weak or strong.
